Terms of Service

1. The service

Halo Explore is a browser-based analytics tool for schools and parents, operated by Dataclysm Pty Ltd (“Dataclysm”, “we”). By using the service you agree to these terms. If you don't agree, please don't use it.

2. Who owns what

You own the data you bring into the app. Because that data stays on your device, we make no claim to it. You own the workspaces, layouts, and notes you create.

We own the Halo Explore software, brand, and service infrastructure. You get a non-exclusive, revocable licence to use it for legitimate educational purposes.

3. Acceptable use

  • Use the service only for lawful, educational purposes.
  • Only upload data you're authorised to process — by your school, the student's guardian, or (in the parent flow) the student in your care.
  • Don't use the service to make final decisions that affect a child without educator review. AI outputs are suggestions.
  • Don't attempt to reverse-engineer, scrape, or disrupt the service, or to circumvent the rate limits and input caps on the AI features.
  • Don't use the service to harass, defame, or harm any person.

4. AI features

The AI features generate probabilistic suggestions based on the aggregate or pseudonymised data you choose to send. Outputs may be incorrect, incomplete, or out of date. You are responsible for reviewing every AI-generated output before acting on it.

5. Availability

Because the app runs in your browser, it works offline for most tasks. Features that depend on our backend (AI agents, cross-device workspace sync) may be unavailable during maintenance or outages. We do not promise continuous availability.

6. No warranties

The service is provided “as is” without warranties of any kind, express or implied, to the maximum extent permitted by law. Nothing in these terms excludes or limits rights you have under the Australian Consumer Law that cannot be excluded.

7. Limitation of liability

To the extent permitted by law, Dataclysm is not liable for indirect, incidental, consequential, or punitive damages arising out of your use of the service. Our aggregate liability for any claim is limited to any fees you've paid us in the 12 months preceding the claim (which, for a free tier, is zero).

8. Changes

We may update these terms from time to time. If we change anything material we'll post the update here and note the change date. Your continued use of the service after a change constitutes acceptance of the updated terms.

9. Governing law

These terms are governed by the laws of Western Australia. Disputes are subject to the exclusive jurisdiction of the courts of Western Australia.
